Terms & Conditions of entry

Please read these Terms & Conditions carefully before purchasing. By purchasing tickets, you are agreeing to be bound by the following Terms & Conditions.

1.0 Definitions
WRC means Whangarei Racing Club.

Tickets and Hospitality Packages means admission tickets to public areas, racecourse stands, and / or specified hospitality areas with defined hospitality packages, or such other rooms, events or products provided by WRC at a Venue.

Venue means Ruakaka Racecourse.

Force Majeure means any event beyond our reasonable control such as, but not limited to, adverse weather conditions, war, acts of terrorism, civil disturbance, any order or act of a government, regulatory or governing body, disease, pandemic, epidemic, fire, flood, labour dispute, lock-out, acts of a third party, and circumstances concerning the health or well-being of animals.

2.0 Agreement
2.1 Bookings are subject to the availability of the requested hospitality area and will not be reserved or confirmed until purchased and full payment is received in accordance with these Terms & Conditions or as agreed in writing by both parties.

2.2 Tickets and Hospitality Packages are non-refundable once purchased, subject to these Terms & Conditions and any obligations WRC owes to any consumer under applicable consumer law.

2.3 By purchasing a ticket you warrant that you are 18 years of age or older. You must have valid proof of age to gain entry to an Event. Persons under the age of 18 years will be denied entry to an Event unless accompanied by a parent or guardian. If you are refused entry or removed from the Event as you are underage or do not have valid proof of age, you will not be entitled to a refund of the ticket price or any part thereof.

3.0 Payment
3.1 All bookings for Tickets and Hospitality Packages must be accompanied by full payment in the form of direct credit or cash.

3.2 GST will apply to all goods and services supplied where applicable. Prices are in New Zealand dollars and include GST unless otherwise stated.

3.3 All Ticket and Hospitality Packages must be consumed within the timeframe as stipulated by WRC.

4.0 Health and Safety
4.1 The Health and Safety at Work Act 2015 requires visitors to take reasonable care that their actions (or lack of action) do not put themselves or others at risk and to follow any reasonable health and safety instructions given to them by WRC.

4.2 Be aware that horses are a hazard on site during racedays. Horses can be aggressive, they can kick out, stand on you and bite. Always be watchful where horses are present. Follow all instructions given by WRC personnel when moving in areas where horses may be present. Stay away from unauthorised access areas unless authorised to do so.

5.0 Use of facilities
5.1 The serving and consumption of alcohol is subject to liquor licensing laws including the Sale and Supply of Alcohol Act 2012 and its requirements. The management and staff of WRC believe that we have a responsibility to provide an environment that is not only comfortable and welcoming but is also where alcohol is served responsibly. With that in mind, the WRC Host Responsibility Policy has been implemented and applies to all events held at the Venue.

5.2 The Venue is a fully licensed venue. “BYO” alcohol is not permitted in any areas.

5.4 Promotional photographs and film footage are taken on Raceday. By entering the Venue, you consent to the use of your image by the WRC and New Zealand Thoroughbred Racing for promotional purposes.

6.0 Facility signage
6.1 No branding or signage is permitted in any general or shared room facility.

7.0 Issue of tickets

7.1 The issue of tickets to a particular facility does not permit entry to any other private facility. However, you may access and utilise public areas.

7.2 WRC will not accept responsibility for misplaced, lost or stolen tickets previously issued. Any replacement tickets will be issued at the sole discretion of the WRC, and WRC reserves the right to charge for the replacement of any tickets issued.

8.0 Display of tickets
8.1 Correct ticketing must be displayed at all times and/or on request. Failure to comply will result in entry being refused or removal from the Venue.

9.0 On selling
9.1 You may not on-sell your ticket. Tickets found to be on-sold will be cancelled.

10.0 Conditions of entry
10.1 WRC has the right to deny entry into, or remove ticket holders from, Raceday where WRC has reasonable grounds to do so, including any breach of these Terms & Conditions, including, but not limited to, intoxication, being under the influence of illicit drugs, being inappropriately attired or deemed by management to be adversely affecting the enjoyment of the Raceday by others.

10.2 You may be required to consent to a search of your person and/or possessions before entering the Raceday, and an identification check at any time. Any refusal may see you refused entry to the Venue, or any facility or area within the Venue, or may require you to leave the Venue. No refund of any part of any ticketed event or activity will apply.

10.3 Entry to Raceday may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from WRC directly.

11.0 Alterations to the Raceday
11.1 Some hospitality areas are outdoors. In such cases, no alternative facilities are available in the event of unfavourable weather.

11.2 If any part of the Raceday including, without limitation, a race meeting, any race, performance or event is cancelled, abandoned or postponed, in whole or in part, due to adverse weather or for any other reason whatsoever that is beyond WRC's control, there is no right to refund or exchange and no obligation is assumed by WRC for the arrangement of a substitute event, performance or any other element.

11.3 Your ticket allows you admission to an Event and includes such additional benefits noted as being included with that ticket on our website (as applicable). Racing Tauranga reserves the right to at its discretion vary, add, withdraw or substitute advertised events, programmes, Meetings, Races, seating arrangements and/or facilities the subject of your ticket. We give no guarantee:

(a) That any Event, Meeting or Race will take place.

(b) That any horse or jockey will appear at any Event, Meeting or Race.

(c) Concerning the nature or quality of any Event, Meeting or Race.

11.4 Due to unforeseen circumstances it may be necessary for WRC to reschedule the Raceday and, if WRC does so, WRC will use its reasonable endeavours to provide you with a comparable facility on the rescheduled day. If WRC does provide a comparable facility on the rescheduled day WRC is not liable to refund your ticket price.

11.5 Programmes, menus and the duration and timing of performances, events and other activities at the Raceday may be subject to alteration without notice. WRC reserves the right to vary, add, withdraw or substitute advertised programmes, menus, seating arrangements and/or facilities at any time.

11.6 Under no circumstances will WRC be liable to you if WRC is unable to perform its obligations under these Terms & Conditions due to any event or cause beyond the reasonable control of WRC.

12.0 Force Majeure

12.1 Under no circumstances will we be liable to you if we are unable to perform our obligations under these Terms due to Force Majeure. In particular, if an Event (or any part of an Event) including, without limitation, a Meeting or a Race is cancelled, abandoned or postponed, in whole or in part, due to Force Majeure, we are not liable to provide you with a refund, credit or exchange and no obligation is assumed by WRC for the arrangement of a substitute Event, Meeting or Race.

13.0 General

13.1 All representations and warranties, whether expressed or implied are excluded to the maximum extent permitted by law. Nothing in these Terms & Conditions affects a Client's rights under applicable consumer law, to the extent that the Client is a consumer for the purposes of the Consumer Guarantees Act.

13.2 These Terms & Conditions are governed by New Zealand law and the parties agree to submit to the exclusive jurisdiction of the courts of New Zealand.
